29 CFR 1910.178(p)(1): 29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition: On or about July 6, 2017, the employer failed to ensure that a powered industrial vehicle (Nissan, vehicle #9276), was removed from service when a defective horn was listed on the pre-operational check list and a mechanical error code of E23 was displayed. Said industrial vehicle was driven despite these findings and was involved in a vehicle vs. pedestrian incident.
