29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who was on a walking/working surface with an unprotected side or edge more than 15 feet* (4.6m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems: a) On or about July 5, 2017 and at times prior to, employees were engaged in installing insulation and standing seam metal roofing. The employees were not utilizing fall protection, exposing them to a fall hazard of about 20 ft. 6 inches to the concrete floor below.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. a) On or about July 5, 2017 and at times prior to, employees were engaged in installing standing seam metal roofing. The employees were lifted on to the roof with a basket attached to LULL D-34 equipment, exposing them to a fall hazard of about 20 ft. 6 inches to the concrete floor below. The basket was not manufacturer's approved attachment.
