29 CFR 1926.303(b)(1): Grinding machines shall be equipped with safety guards in conformance with the requirements of American National Standards Institute, B7.1-1970, Safety Code for the Use, Care and Protection of Abrasive Wheels, and paragraph (d) of this section: a) 6th Ave N Trench: On or about July 6 2017, and at times prior, employees were exposed to lacerations while using the unguarded DeWalt 4 1/2 inch right angle grinder (model # DC411, serial # 308718) to cut sewer pipe.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) 6th Ave N Trench: On July 6, 2017, and at times prior, the employer certified on the Daily Trenching Log that; the soil classification was class "C" with wet soil conditions, that the trench would reach depths of approximately six feet and five feet in width, excavated material was two feet from the edge of the excavation, ladders were within twenty five feet of the employees, and that trench boxes would be the protective systems used. Employees were allowed to enter the excavation to install a new sewer line without any of these necessary precautions in place. b) Headstart Trench: On July 6, 2017, and at times prior, the employer certified on the Daily Trenching Log that; the soil classification was class "C" with wet soil conditions, that the trench would reach depths of approximately six feet and five feet in width, excavated material was two feet from the edge of the excavation, ladders were within twenty five feet of the employees, and that trench boxes would be the protective systems used. 29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) 6th Ave Trench: On or about July 6, 2017, and at times prior, employees were exposed to cave-in hazards while tying into existing water lines in a trench that approximately seven feet in depth. b) Head Start Trench: On or about July 6, 2017, and at times prior, as the controlling employer did not ensure that Star Services, Inc. employees were not exposed to cave-in hazards while tying into existing water lines in a trench that was approximately six feet in depth.
