29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    An effective hearing conservation program, which included noise monitoring, audiometric testing of employees and training of employees as detailed in the standard, was not instituted by Bio Packaging Films, LLC.    a) On July 12, 2017, an employee operated several film production lines. This employee was exposed to continuous noise levels at 71.8% of the allowable 8-hour time-weighted average (TWA) sound level (90 dBA). The equivalent dBA level of 71.8% is approximately 87.6 dBA. The sampling was performed for 325 minutes during one 8-hour work shift on July 12, 2017.  Zero exposure was assumed for the unsampled period of time, 155 minutes.     b) On July 12, 2017, an employee assisted an operator operate several film production lines. This employee was exposed to continuous noise levels at 87.5% of the allowable 8-hour time-weighted average (TWA) sound level (90 dBA). The equivalent dBA level of 87.5% is approximately 89.0 dBA. The sampling was performed for 455 minutes during one 8-hour work shift on July 12, 2017.  Zero exposure was assumed for the unsampled period of time, 25 minutes.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    a) On or about July 6, 2017, Bio Packaging Films, LLC did not provide information and training to employees exposed to hazardous chemicals relating to the heating byproducts of polyethylene. These chemicals include, but are not limited to: carbon monoxide, ketones, hydrocarbons, and formaldehyde.    b) On or about July 6, 2017, Bio Packaging Films, LLC did not provide training to employees by December 1, 2013 on the revised Safety Data Sheet format and content as well as the new labeling elements as required by the revised hazard communication standard 29 CFR 1910.1200.    Bio Packaging Films, LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.1200(h)(1), which was contained in OSHA inspection number 1009411, citation number 1, item number 2b and was affirmed as a final order on February 5, 2015, with respect to a workplace located at 909 Tower Rd. Mundelein, IL 60060.    No abatement certification or documentation is required for this item.
