OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fall hazards: a) 2101 Birmingham Hwy (Opelika, AL); On or about June 20, 2017 and at times prior thereto, employees working from a scissor lift while installing sheeting to the exterior of a structure were exposed to fall hazards of 15 feet to the ground below, in that the employer permitted employees to stand on the top rail of the scissors lift.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: a) 2101 Birmingham Hwy (Opelika, AL); On or about June 20, 2017 and at times prior there thereto, the employer exposed employees working in the basket of an aerial lift installing sheeting to fall hazards of 15 feet to the ground below in that the employer failed to ensure employees were tied off to the basket using a body belt and lanyard or other fall restraint system.
