OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by flying projectiles:      Maintenance Yard:  On or about July 21, 2017, employees were exposed to the hazard of being stuck by flying projectiles, while operating compressed air equipment.  The compressed air used by the equipment was transported above grade via 3/4" PVC Pipe at an operating pressure of approximately 130 psi.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  Maintenance Yard: On or about July 21, 2017, employees were exposed to health hazards when the employer did not establish a written respiratory protection program or implement provisions of the program such as, but not limited to, medical evaluations or fit tests, for employees who were required to wear MSA Comfo Classic respirators with P-100/Multi gas cartridges.

29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  Navistar International Transportation Corp Water Truck:  On or about July 21, 2017, an employee was exposed to confined space hazards such as oxygen deficiency and IDLH, while entering a water truck reservoir to apply SEAL-GAP sealant without the employer developing and implementing a written permit space entry program.
