(a)  Jon Butler D.B.A. Jon Butler at 3800 East 15th Street in Sioux Falls, SD 57103: On and prior to July 7, 2017, The exposing employer did not ensure fall protection systems were used for work performed out of an aerial lift Two employees were exposed to fall hazards when operating an aerial lift from the personnel basket, at a range of elevations above between 14-60 ft above a lower level, while not wearing a personal fall arrest or restraint system.     Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).
