29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Methods such as: placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary were not used. A. Peterson Construction Company worksite located at 527 Wellsted St., Napoleon, Ohio: On or about July 5, 2017, the employer did not ensure excavated material was placed at least two feet from the edge of the excavation. One employee laying new utility pipe in a trench was potentially exposed to fallen soil from the spoil pile placed on the North side of the excavated trench.
