OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling containers (dumpsters.    (a) Employees were emptying the contents of rear loading containers (dumpsters) into the hopper of a 1995 White GM Rear-loaded Garbage Truck (VIN: 4V2JCBBE3SR837028) where trunnion bar latches were not serviceable or available for use, exposing employees to the hazard of being struck by a falling container.    (b) Employees were emptying the contents of rear loading containers (dumpsters) into the hopper of a 1995 White GM Rear-loaded Garbage Truck (VIN: 4V2JCBBE3SR837028) did not lower the containers to the ground prior to engaging the hopper blade, exposing employees to the hazard of being struck by a falling container.     Violation occurred on or about 29 June 2017.

29 CFR 1910.141(c)(1)(i): Toilet facilities were not provided in all places of employment in accordance with table J-1 of this section, which requires a minimum of 1 water closet for establishments with 1 to 15 employees.     On or about 20 July 2017, and at times prior thereto, five employees working at the CDSI facility were not provided with a  toilet facility, exposing the employees to the hazards associated with urinary retention.

29 CFR 1910.151(b): In the absence of an infirmary, clinic, or hospital in near proximity to the workplace for the treatment of all injured employees, a person or persons was not adequately trained to render first aid. Adequate first aid supplies were not readily available:     On or about 7 July 2017, and at times prior thereto, the employer did not provide readily available first aid treatment and first aid supplies for employees, exposing employees to the hazards associated with the delay of medical treatment.    (a) Employees are required to pick up refuse containers on routes that take them up to approximately 30 miles away from the nearest medical facilities without adequately trained personnel available to render first aid.     (b) First aid supplies were not available on site at the CDSI facility and inside vehicles used to pick up refuse materials on rural routes.

29 CFR 1910.303(g)(1)(vii)(B): Outdoor electrical equipment was not installed in suitable enclosures and was not protected from accidental contact by unauthorized personnel, or by vehicular traffic.    On or about 6 July 2017, and at times prior thereto, employees mowing and trimming the grass behind the office were required to move and work around a 120V electrical branch circuit that was laying on the ground and spliced from previously being cut by lawn mowing equipment, exposing the employees to an electrical shock hazard.

On or about 19 July 2017, and at times prior thereto, in the maintenance shop, employees were required to switch breakers and work in close proximity to an electric panel board that had exposed live electric parts up to 480-V, due to a missing cover, exposing the employees to the hazard of electric shock.

29 CFR 1904.39(a)(1):  The employer failed to report a fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor within eight (8) hours after the death of an employee as a result of a work-related incident.    On or about 29 June 2017, the employer failed to report a workplace fatality of an employee that was struck by a dumpster when it was dislodged from the back of a rear loading garbage truck.
