29 CFR 1926.451(c)(2)(v): The employer did not ensure that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied: The employer is failing to protect employees from fall hazards associated with working on a platform that has been elevated more than 10 feet above the ground by an all-terrain forklift. The most recent occurrence of this took place at the new home being built at 7224 N. 140th Ave Omaha, NE where the employer has an unprotected employee lifted up into a work position greater than 10 feet from the ground below in preparation to install siding without securing the platform to the forks by means other than relying on friction to prevent the platform from sliding off the forks.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs(g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: The employer is failing to protect employees from fall hazards associated with working on a platform that has been elevated more than 10 feet above the ground by an all-terrain forklift. The most recent occurrence of this took place at the new home being built at 7224 N. 140th Ave Omaha, NE where the employer has an unprotected employee lifted up into a work position greater than 10 feet from the ground below in preparation to install siding without having guarded all exposed sides of the platform. Specifically half of the side of the platform that runs along the side of the house juts past the corner of the home exposing the employee to a fall hazard of greater than 10 feet.
