OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard of receiving various injuries from the lack of enforcement of wearing seat belts while operating the forklift without wearing the seatbelt. a) Throughout the facility, on or about 6/28/17: Employee was operating a Clark Forklift Model C35D and was not wearing the seat belt provided on the forklift. ABATEMENT NOTES: Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1. Require and enforce the use of seat belt that is provided on the fork truck. 2. Follow the instructions listed in the Clark OM-763 February 2014 Manual Pages 1-4 and 4-4
