29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.      a) Worksite, 35 Smith St., Merrick, NY - An employee engaged in roof work was observed using a pneumatic nail gun to fasten roofing shingles. The employee was not wearing eye protection; or about 7/11/2017.        Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a) Worksite, 35 Smith St., Merrick, NY - Employees were observed working at the edge of a roof approximately 20' above the ground below without the use of guardrail, safety net or fall arrest systems; on or about; or about 7/11/2017.     Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
