29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) In the undeveloped culvert area of the 6000 block of Fairmont Parkway, the designated competent person was not competent in that he did not know how to type soil, did not know the regulations contained in 29 CFR 1926 Subpart P, and did not know how to select an appropriate protective system.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): a) In the undeveloped culvert area of the 6000 block of Fairmont Parkway, a trench where employees were making a connection to an existing manhole was not sloped or benched at 1:1, nor was a protective system used.
