29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. Construction Site: On or about July 12, 2017, employees were observed working on commercial construction without the use of proper fall protection equipment. This condition exposed employees to fall hazards greater than 6-feet to the ground below.

29 CFR 1926.761(b): The employer did not train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer did not institute a training program and ensure employee participation in the program. Construction Site: On or about July 12, 2017 employees were observed without use of any fall protection systems at heights above 6 feet, this indicated employees had not retained the understanding or skill of fall protection training. This condition exposed employees to a fall protection hazard.
