29 CFR 1926.502(c(3): The employer did not ensure affected employee's knowledge or use of fall protection systems or equipment indicated that the employee's retained the requisite understanding or skill: a) On or about 7/13/17 on roof E of the Lackawanna Middle School Building, 500 Martin Rd., Lackawanna, NY: Two employees engaged in roofing work on a flat roof were applying sealant at the roof edge around the perimeter of the roof and were protected from falling approx. 12 ft. off the west and south sides of the roof by a proper wood guardrail system consisting of horizontal wood 2 x 4 toprails, and horizontal wood 2 x 4 midrails, installed at the proper height. The toprails and midrails were nailed into vertical wood 2 x 4 posts, spaced 5 ft. on center. The employees had just completed the sealing work on the west and south sides of the roof and were working on the east side, moving north. Shortly ahead of them was a section of guardrail that had a span of approx. 14 foot where no vertical post was installed. This horizontal span of the toprails and midrails was greater than the 8 foot span between vertical posts recommended for wooden guardrails in Appendix B of Subpart M of this standard. This section was located above two dumpsters setting on the ground. There was a short steep wood ramp just beyond this section of guardrail. Employees were exposed to a potential fall of approx. 9 ft. to the bottom of the dumpster. NO ABATEMENT CERTIFICATION REQUIRED
