29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard in the workplace:    (a) NGL Energy Partners LP, at 1635 CR19, Brighton, CO: On and preceding 7/13/17, the employer did not identify and evaluate the respiratory hazard in the workplace.  Employees performed gauging of produced water tanks at the well injection site.  Employees performed these tasks at open thief hatches.  Employees wore hydrogen sulfide monitors.  The employer did not evaluate employee exposure to respiratory hazards, including oxygen deficient atmospheres and hydrocarbon gases and vapors, including benzene.  This condition exposed employees to respiratory hazards.    (b) NGL Energy Partners LP, at 1635 CR19, Brighton, CO: On and preceding 7/13/17, the employer did not identify and evaluate the respiratory hazard in the workplace.  Employees visually inspect produced water before offloading at the injection well disposal site.  Employees wore hydrogen sulfide monitors.  The employer did not evaluate employee exposure to respiratory hazards, including oxygen deficient atmospheres and hydrocarbon gases and vapors, including benzene.  This condition exposed employees to respiratory hazards.    Abatement Note: The employer shall provide and ensure that employees use four gas meters when performing tank gauging operations, or any operation that may expose them to hydrocarbon gases or vapors.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:    (a) NGL Energy Partners LP, at 1635 CR19, Brighton, CO: On and preceding 7/13/17, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  The oil sell tank was not labeled or marked indicating the presence and hazards of chemicals including, but not limited to benzene.  This condition exposed employees to a chemical hazard.

29 CFR 1910.1200(h)(1): Employer had not provided employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area:      (a) NGL Energy Partners LP, at 1635 CR19, Brighton, CO: On and preceding 7/13/17, the employer had not provided employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area.  Employees performed gauging of produced water tanks at the well injection site.  Employees performed these tasks at open thief hatches.  Flammable hydrocarbon gases were vented through open thief hatches.  The employer did not train employees with regards to oxygen deficient atmospheres, which are Immediately Dangerous to Life or Health (IDLH).  This condition exposed employees to a respiratory hazard.
