29 CFR 1910.1200(h)(1): Employer had not provided employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area:  (a)  Juan Castillo Enterprises LLC at 847 S. Columbine, Denver, CO 80209; On and before July 17, 2017, the employer had not provided employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment.  An employee used a saw to cut concrete roofing tiles.  The employee had not been provided training on hazardous chemicals in his work area, including concrete dust (containing respirable silica).  Note: The requirements applicable to construction work under 1926.59 are identical to those set forth in 29 CFR 1910.1200

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure:  (a)  Juan Castillo Enterprises LLC at 847 S. Columbine, Denver, CO 80209; On and before July 17, 2017, the employer did not ensure that each employee engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure.  Workers were roofing a two story home.  The workers were not protected from a fall.  This condition exposed the workers to a fall hazard of greater than 20 feet.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard in the workplace:  (a)  Juan Castillo Enterprises LLC at 847 S. Columbine, Denver, CO 80209; On and before July 17, 2017, the employer did not identify and evaluate the respiratory hazard in the workplace.  An employee used a saw to cut concrete roofing tiles.  Concrete contains crystalline quartz.  The sawing of concrete potentially released respirable silica.  Employee exposure to respirable silica had not been determined.  This condition potentially exposed the employee to a respiratory hazard.  Note: The requirements applicable to construction work under 1926.103 are identical to those set forth in 29 CFR 1910.134.
