29 CFR 1910.23(b)(8): The employer did not ensure ladders were used only for the purposes for which they were designed. ESTABLISHMENT: The employer did not ensure that the Husky 6-foot stepladder was used in the properly opened position at all times. On or about 07/14/17, the above stepladder, which was placed on top of platform of a mobile scaffold, was used in closed position while an employee was trying to check and repair for a leak of a ceiling window. The employee lost balance and fell to the floor with the stepladder and sustained a fatal head injury from the incident.

29 CFR 1910.27(a): Scaffolds used in general industry did not meet the requirements in 29 CFR Part 1926, Subpart L(Scaffolds), in that ladders were used on scaffolds to increase the working level height of employees. ESTABLISHMENT: A Husky 6-foot stepladder was placed on the platform of a mobile scaffold to obtain additional working level height. On or about 07/14/17, the above stepladder, which was in the closed position and placed on top of platform of a mobile scaffold, to increase an employee's working level height while the employee was trying to check and repair a water leak of a ceiling window. The employee lost his balance and fell to the floor with the stepladder and sustained a fatal head injury from the incident.

29 CFR 1910.30(b)(1): The employer did not train each employee on or before May 17, 2017 in the proper care, inspection, storage, and use of equipment covered by this subpart before an employee uses the equipment: ESTABLISHMENT: The employee, performing tasks from a stepladder that was placed in closed position on the platform of a mobile scaffold was not provided with appropriate information and training in the proper care, inspection, storage, and use of equipment before the employee was using the equipment. On or about 07/14/17, the employee was using the stepladder to increase the working level height while trying to check and repair for a leak of a ceiling window. The employee lost balance and fell to the floor with the stepladder and sustained a fatal head injury from the incident.
