OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting caught-in or between a tipping forklift and the ground: a) 3527 Union Deposit Road, Harrisburg PA - The operator of a JCB T4i IIIB telescopic forklift was observed not wearing the attached seatbelt, thus exposing the operator to crushing injuries associated with tipover hazards, on or about July 13, 2017. No abatement certification or documentation required.

29 CFR 1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. and as referenced by the note contained in 1926.602(d). a) 3527 Union Deposit Road, Harrisburg PA - On or about July 13, 2017 and times prior thereto, employees were authorized to operate a JCB T4i IIIB telescopic forklift and did not receive a combination of formal instruction, practical training, and evaluation of the operator's performance. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The use of a body belt in a tethering or in a restraint system is acceptable and is regulated under Sec. 1926.502(e). a) 3527 Union Deposit Road, Harrisburg PA - Employees were observed using a JLG 600S Telescopic Boom Lift to access/egress the roof of a building and did not don a body belt or harness with lanyard attached to the boom or basket and were exposed to an approximate 14 foot fall hazard to the ground below, on or about July 13, 2017. b) 3527 Union Deposit Road, Harrisburg PA - Employees were observed operating a JLG 600S Telescopic Boom Lift and did not don a body belt or harness with lanyard attached to the boom or basket and were exposed to an approximate 14 foot fall hazard to the ground below, on or about July 13, 2017. The employees were parking the lift. No abatement certification or documentation required.
