29 CFR 1926.651(b)(3): When excavation operations approached the estimated location of underground installations, the exact location of the installations was not determined by safe and acceptable means: a) West Side of Building - On or about June 5, 2017, workers did not use safe and acceptable means to determine the exact location of an existing underground installation, in that, a backhoe and employees using conventional hand tools were the only means employed to determine the exact location of a n existing duct bank during a repair operation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
