Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards:     On or about July 20, 2017 and then again, on or about October 31, 2017, at the above addressed worksite, employees were operating powered industrial trucks without wearing a seatbelt. Those employees were exposed to hazards, such as, but not limited to being struck by moving objects or falling loads; and/or crushed by forklift tipping.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written  approval.  On or about July 20, 2017, at the above addressed worksite, employees were operating forklifts that had attachments used for free rigging the materials from the tines of the forklifts. The company had not received approval from the manufacturer of the forklifts for the use of the attachments.

On or about October 31, 2017, at the above addressed worksite, the employer did not ensure that each operator of powered industrial trucks was trained and evaluated within the time frames required by the standard. The employer is not providing formal instruction nor practical training for all of the operators on site within three (3) years of their last evaluation and training.

On or about July 20, 2017, at the above addressed worksite, the employer did not provide any effective information and training on hazardous chemicals that included, but not limited to, the GHS requirements about pictograms, labeling and hazards, for employees that are working with hazardous chemicals, such as, but not limited to, Isopropyl Alcohol and Silicone Glazing Sealant.
