OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck-by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured. (a) Building bay: On or about August 15, 2017 and at times prior thereto the Company used Polyvinyl Chloride (PVC) plastic piping in exposed above ground locations to transport compressed air at 132 psi.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) Building Bay: On or about August 15, 2017 and times prior thereto an employee building barns using a nail gun was exposed to noise at a dose level of 72.5% (equivalent to an 8 hour TWA of 88.9dBA) which is approximately 1.45 times the action level of 50% (equivalent to an 8 hour TWA of 85dBA) and the employer did not administer a continuing and effective hearing conservation program as described in 29 CFR 1910.95(c) through (o).
