29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a- 226 Dune Avenue, Brick Township NJ - Company employees (working from a ladder jack scaffold) were exposed to fall hazards, in excess of 19 feet to the ground surface below, while performing roofing and other related activities while not using the required fall protection and while the ladder jack scaffold's feet were not set on sound footings.   On the day of the worksite inspection, the exposed employees and the company owner had not received scaffold hazard recognition and minimization training by a qualified person.  Condition noted on or about 07/19/17.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(c)(2)(i): Footings were not level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement:  a- 226 Dune Avenue, Brick Township NJ - Company employees were exposed to fall hazards, in excess of 19 feet to the ground surface below, while performing roofing and other related activities from a ladder jack scaffold whose feet were not set on sound footings that would have prevented settling or displacement.  Condition noted on or about 07/19/17.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a- 226 Dune Avenue, Brick Township NJ - Company employees were exposed to fall hazards, in excess of 19 feet to the ground surface below, while performing roofing and other related activities from the walking/working surface of a ladder jack scaffold that was missing guardrails and end stops.  Condition noted on or about 07/19/17.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
