29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. (a) At a commercial construction site located at 2733 Gillham Road, Kansas City MO: Employees were exposed to potentially serious injuries and/or illnesses in that the employer had not developed, or successfully implemented, an effective safety and health program. The employer failed to train their employees on the recognition of hazards associated with falls as was demonstrated on 7/19/2017 when employees were exposed to fall hazards while working from a ladder on the balcony of a second story building and had not been trained in the regulations applicable to their work.

This was demonstrated on 7/19/2017 when employees were allowed to work in an opening parking area to cut and assemble wood materials while the hand held saw and nail gun were run through an open window on the third floor.

29 CFR 1926.1053(b)(14): Crossbracing on the rear section of stepladders, not designed and provided with steps for climbing on both front and rear sections, was used for climbing: a) Employee were exposed to fall hazards at a commercial construction site located at 2733 Gillham Road in Kansas City, MO. The employer failed to protect employees from fall hazards associated with the misuse of a step ladder in which employees were allowed to stand of the rear cross bracing of the ladder as if it were a step. This was demonstrated on 7/19/2017 when an employee was observed straddling a step ladder and using the rear cross brace as a step to gain access to the third floor balcony.
