29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 7/18/17 at a water line project located at Caulkins Road, Rochester, New York; employees were in three separate excavations exposing pipes to make repairs. The excavations were approximately 5'-6" to 7'-0" deep with partially sloped sidewalls. The slope of the sidewalls was not in accordance with 29 CFR 1926.652(b) for the soil conditions identified. NO ABATEMENT CERTIFICATION REQUIRED
