29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:     (a) LIV unLtd LLC, working in the swimming pool facility at 535 W End Ave. are required to wear a 3M half-face respirator with an Organic Vapor - Acid Gas cartridge; the employer did not implemented a respiratory protection program. The condition was noted on or about 07/26/17.        NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER  IS REQUIRED TO SUBMIT ABATEMENT  DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:     (a) LIV unLtd LLC, working in the swimming pool facility at 535 W End Ave. are required to wear a 3M half-face respirator with an Organic Vapor - Acid Gas cartridge; the employer did not provide medical evaluation to determine the ability of the employees to wear a respirator. The condition was noted on or about 07/26/17.       NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER  IS REQUIRED TO SUBMIT ABATEMENT  DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein:   (a) LIV unLtd LLC employees, working in the fitness and entertainment facilities at 535 W End Ave., transferred hazardous chemicals, such as Hydrochloric acid, and Sodium Hypochlorite, into secondary containers; the secondary containers were not labeled with the appropriate hazard warnings. The condition was noted on or about 07/26/17. The condition was noted on or about 07/26/17.
