OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees working in the danger zone of the front end loader were exposed to struck by hazards: On or about July 25, 2017 at the Oneida Street bridge, Appleton, Wisconsin project, a Volvo L110F (PIN#VCEL110FL00061930#) front end loader with fork attachment was used to transport equipment on the jobsite. A nylon sling rigged to a load was hung from one fork and hoisted for transport. While in route the load swung, moving an employee guiding the load in to the path of travel of the front end loader. The employee sustained serious injuries as a result of being struck by the moving loaders tire.

29 CFR 1926.251(a)(6): "Inspections." Each day before being used, the sling and all fastenings and attachments shall be inspected for damage or defects by a competent person designated by the employer. Additional inspections shall be performed during sling use, where service conditions warrant. Damaged or defective slings shall be immediately removed from service. On or about July 26, 2017 at the Oneida Street bridge jobsite; a Rockford Nylon Web Sling (S/N: 3714_6-38) had two deep cuts/frays and a smashed section in the sling. The sling was not taken out of service, but just placed in the job box available for use.
