29 CFR 1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability (Construction Reference 1926.103): On or about July 13, 2017, and times prior thereto, the employer did not provide adequate respiratory protection for employees using Delcrete/Delpatch DSB 1494 A and B. The employees were provided a Moldex 1200 N95 filtering facepiece exposing employees to toluene diisocyante, a respiratory sensitizer and respiratory inhalation hazard.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area (Construction Reference 1926.59): On or about July 13, 2017, and times prior thereto, the employer did not provide hazard communication training on the Delcrete/Delpatch DSB 1494 A and B when introduced into the workplace. Employees using Delcrete/Delpatch DSB 1494 A and B were exposed to toluene diisocyante, a respiratory sensitizer and inhalation hazard.
