In the Alternative      OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that wer causing or likely to cause death or serious physical harm to employee in that employee were exposed to being struck-by flying chips of red hot metal.       On or about July 21, 2017, and at times prior thereto:      a. In the forging hammer area where employees were exposed to struck-by hazards while working near an 8,000 pound forging hammer without protection from flying chips and sparks created during the hammering action.       b. In the forging hammer area where employees were exposed to struck-by hazards while working near a 16,000 pound forging hammer without protection from flying chips and sparks created during the hammering action.
