OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:      1) On July 25, 2017, and at prior times, employees were exposed to fire hazards, in that a catalyst containing methyl ethyl ketone peroxide, an organic peroxide, was stored near flammable liquids such as styrene inside the flammable storage room.      Among other methods, some feasible and acceptable methods to abate the hazard are to:      a) ensure that organic peroxide storage conforms with NFPA 400- Hazardous Materials Code, which states Incompatible materials and flammable liquids shall not be stored within 25 ft. (7.6 m) of organic peroxide formulations. (Chapter 14.3.2.9-1)        b) store products containing MEKP in a separate, approved flammable storage cabinet or room from flammable liquids stored in the flammable storage room.

29 CFR 1910.106(e)(2)(ii)(a): Except as provided in subdivisions (b) and (c) of this subdivision, all storage shall comply with paragraph (d) (3) or (4) of this section:      1) On July 25, 2017, and at prior times, the flammable liquid storage room did not have a mechanical or gravity ventilation system, as required by 1910.106(d)(4)(iv).    2) On July 25, 2017, and at prior times, category 3 flammable liquids with a flash point below 100 degrees F were stored in the flammable liquid storage room.  The light fixture in the room was not approved for Class I, Division 2 hazardous locations as required by 1910.106(d)(4)(iii), in that the cover for the fixture was missing and the light bulb was exposed.

29 CFR 1910.107(e)(2): The quantity of Category 2, 3 or 4 flammable liquid located outside of an inside storage room or storage cabinet in a building or in any one fire area of a building exceeded 120 gallons:    1) On July 25, 2017, and at prior times, approximately 165 gallons of gel coat, a category 3 flammable liquid, was stored outside of an approve storage room in the production area.
