OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ejection and crushing hazards while operating powered industrial trucks:  a) Catering Area (outside the kitchen area): The Hyster P60 model number H60XL propane forklift was not equipped with a restraint device (seatbelt) exposing employees to ejection and crushed-by hazards as observed on or about July 27, 2017l                                                                                    ABATEMENT CERTIFICATION IS REQUIRED FOR THIS VIOLATION.

29 CFR 1910.67(c)(2)(v):  A body belt was not worn and lanyard was not attached to the boom or basket when working from an aerial lift.   a) At the 1001 Nacht ride:  Two employees were inside the platform of the JLG Ultra Boom 1350SJP about three feet high from ground level to the platform of the ride without appropriate fall protection, as observed on or about  July 27, 2017.                                                                                   CORRECTED DURING INSPECTION.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s):  a) Throughout the amusement park:  The Hyster 60 model H60XL and the Kamatzu 153 propane forklift trucks had defective horns and were not taken out of service until restored to safe operating conditions. Employees were exposed to struck-by hazards as observed on or about July 27, 2017     ABATEMENT CERTIFICATION IS REQUIRED FOR THIS VIOLATION.
