On or about July 25, 2017, employees were utilizing a mobile ladder to access the top of tanks and there were defects to the structure of the ladder, thereby exposing employees to fall hazards.

(i) Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: a. On or about July 5, 2017, an employee was servicing the top of the Evergreen Tank Solution Frac Tank # VB11064, and was not protected from falling to the ground below, thereby the employee was exposed to fall hazards.
