29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (a) C.M. High, Incorporated - The employer did not adequately evaluate the respiratory hazards for the employees cutting roadways, both asphalt and concrete, with dry concrete saws; thus, potentially exposing employees to silica, on or about July 31, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement was complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) C. M. High, Incorporated - The employer did not establish a written respirator program which met the requirements of the standard nor did the employer conduct medical evaluations for the employees wearing the 3M half-mask elastomeric face piece respirators for protection against dust including silica, on or about July 31, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement was complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
