29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there was an exposure to hazardous conditions: a) East side of building, 357-368 Manor Ln, Marlton, NJ: Employee was not using any eye protection when using the pneumatic nail gun to attach the starter row of shingles along the eave of the roof, on or about 07/27/2017; b) West side of building, 357-368 Manor Ln, Marlton, NJ: A different employee was not using any eye protection when using the pneumatic nail gun to attach the starter row of shingles along the eave of the roof, on or about 07/27/2017; c) West side of building, on the ground, 357-368 Manor Ln, Marlton, NJ: Employee without any head protection and responsible for cleaning up the construction debris and keeping roofing materials organized was exposed to overhead hazards such as pneumatic nail guns and other heavy tools that might fall from the edge of the roof approximately 15 feet above him, on or about 07/27/2017. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) NOTE TO CSHO: USE THIS OPTION ONLY IN CASES WHERE THE INFEASIBILITY/GREATER HAZARD EXCEPTION IS NOT IN ISSUE. a) Working on the east side of roof at 357-368 Manor Ln, Marlton, NJ: Employee without any fall protection was installing shingles at the edge of the roof approximately 20 feet above ground, on or about 07/27/2017; b) Working near north end of roof at 357-368 Manor Ln, Marlton, NJ: Two employees without any fall protection approximately 20-28 feet above ground level were installing new shingles, on or about 07/27/2017; c) Working near north end of roof at 357-368 Manor Ln, Marlton, NJ: Employee without any fall protection was installing shingles at the edge of the roof approximately 20 feet above ground, on or about 07/27/2017; d) Working near eave, west side of roof at 357-368 Manor Ln, Marlton, NJ: Two employees without any fall protection approximately 20 feet above ground level were installing new shingles, on or about 07/27/2017. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
