29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face. (a) Leading Edge Technologies, Inc. at 5185 Main Gord Drive South, Vail, CO 81657; On and before July 31, 2017, the employer failed to ensure that employees working in an excavation were adequately protected against loose rock or soil that could pose a hazard by falling or rolling from the excavation face. Specifically, an employee operating a backhoe was struck by a boulder which caused the back hoe to roll over damaging the back hoe. This was due to a lack of scaling to remove loose material; installation of protective barricades at intervals as necessary on the face to stop and contain falling material; or other means that provide equivalent protection.
