29 CFR 1910.106(d)(2)(i): Approved containers and portable tanks were not used for the storage of flammable liquids: (a) Yard - The employer used a 275-gallon oil burner fuel tank to store salvaged gasoline. This tank did not constitute an approved portable tank for the storage of gasoline (a Category 2 flammable liquid) but rather consisted of a tank intended for fixed use and for the storage of heating fuels for oil burning equipment or for the storage of diesel fuels for compression ignition engines and motor oils (Category 3 flammable liquids with flashpoints at or above 100 degrees Fahrenheit) only, exposing employees to the hazards of fire and explosion, on or about August 3, 2017. (b) Yard - Employees used plastic five-gallon buckets to collect salvaged gasoline from the fuel tanks of end-of-life vehicles rather than containers approved for flammable liquids, exposing employees to the hazards of fire and explosion, on or about August 3, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.106(e)(2)(iv)(d): Flammable liquids were not drawn from or transferred into vessels, containers, or portable tanks within a building only through a closed piping system, from safety cans, by means of a device drawing through the top, or from a container or portable tanks by gravity through an approved self-closing valve: (a) Shop - To remove gasoline (a category 2 flammable liquid) from fuel tanks of end-of-life vehicles, employees raised each vehicle on one of the vehicle lifts inside the shop building, put a hole in the vehicle's gasoline tank, and allowed the gasoline to free flow into a metal drum positioned below on the shop floor rather than transferring the flammable liquid between containers, within a building, only through closed piping, from approved safety cans, by a device drawing through the top, or from a container or portable tanks by gravity through an approved self-closing valve, exposing employees to the hazards of fire and explosion, on or about July 13, 2017. No abatement certification or documentation required.

29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors from sources such as open flames; lightning; smoking; cutting and welding; hot surfaces; frictional heat; static, electrical, and mechanical sparks; spontaneous ignition, including heat-producing chemical reactions; and radiant heat: (a) Yard - Employees salvaged gasoline from fuel tanks of end-of-life vehicles by placing the vehicle on top of two concrete Jersey barriers, piercing the vehicle's fuel tank, and letting the gasoline free flow by gravity into a plastic five-gallon bucket placed under the vehicle. After the gasoline finished draining from the vehicle's fuel tank, employees poured the gasoline from the plastic five-gallon bucket into a 275-gallon oil burner fuel tank via a plastic funnel in the top of the tank. The employer did not have any of the tanks or containers or the funnel grounded to dissipate static charges generated by the flow of the flammable liquid during the transfers, exposing employees to the hazards of fire and explosion, on or about, on or about August 3, 2017. (b) Yard - Employees salvaged gasoline from of end-of-life vehicles with metal fuel tanks by placing the vehicle on top of two concrete Jersey barriers and piercing metal fuel tanks with a pick axe made of ferrous material, capable of generating sparks, rather than using a non-sparking tool, exposing employees to the hazards of fire and explosion, on or about, on or about August 3, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

The employees did not bond the vehicle to the plastic five-gallon bucket and did not bond the plastic five-gallon bucket to the plastic funnel to dissipate static charges, generated by the flow of the flammable liquid during the transfers, exposing employees to the hazards of fire and explosion, on or about, on or about August 3, 2017. 29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling: (a) Yard - The employer used nonmetallic-sheathed (NM) cable as a flexible cord to power the GPI Model 1115S fuel transfer pump installed on the 275-gallon oil burner fuel tank that contained salvaged gasoline. The employer wired the NM cable at one end into the motor of the GPI Model 1115S fuel transfer pump, wired an attachment plug onto the other end of the cable, and then plugged the attachment plug into a receptacle on a generator to power the pump. The UL listing for nonmetallic-sheathed cable specifies using the cable in accordance with Article 334 of ANSI/NFPA 70, the National Electrical Code (NEC), which specifies using NM cable as premises or building wiring, exposing employees to an electrical hazard, on or about August 7, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
