29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a. On or about August 2, 2017, at the Texas Roadhouse brand, new construction restaurant building site, employees using pneumatic type nail guns to install sheathing panels were not protected with eye protection, exposing them to eye injuries caused by airborne debris generated by the nailing process. b. On or about August 3, 2017, at the Texas Roadhouse brand, new construction restaurant building site, employees using pneumatic type nail guns to install sheathing panels were not protected with eye protection, exposing them to eye injuries caused by airborne debris generated by the nailing process.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on August 2, 2017, when employees are working to install roof sheathing panels while on the second story, 6:12 pitch steep roof of a new construction, restaurant building at the Texas Roadhouse project in Jacksonville, Florida without fall protection and are exposed to a 23-foot, 4-inch fall hazard to the concrete floor below. JB Builders 1, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1199991, citation number 1, item number 1 and was affirmed as a final order on March 2, 2017, with respect to a workplace located at 20 Shops At Five Way, Plymouth, MA 02360.
