29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:    The employer is failing to protect employees from hazards during permit required confined space entry as the employer did not implement a permit space entry program for employees entering sanitary sewer manholes during sewer and drain cleaning.  The condition was most recently observed at the intersection of Dorsett and Fee Fee Road, Maryland Heights, MO when an employee entered a sanitary sewer manhole to visually inspect the sewer line after dislodging an obstruction.

29 CFR 1910.146(d)(3): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including, but not limited to items (d)(3)(i) through (d)(3)(vi) of this paragraph:  The employer is failing to develop and implement the means, procedures, and practices necessary for safe permit space entry operations into sewer manholes as follows:     a. Failing to specify acceptable entry conditions as required by item (d)(3)(i);     b. Failing to provide each authorized entrant with the opportunity to observe monitoring or testing of permit spaces as required by item (d)(3)(ii);     c. Failing to ventilate the permit space as necessary to eliminate or control atmospheric hazards as required by item (d)(3)(iv);     d. Failing to provide pedestrian, vehicle, or other barriers as necessary to protect entrants from external hazards as required by item (d)(3)(v);     e.  Failing to verify that conditions in the permit space are acceptable for entry throughout the duration of an authorized entry as required by (d)(3)(vi).

29 CFR 1910.146(d)(10): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement a system for the preparation, issuance, use, and cancellation of entry permits as required:   The employer failed to develop and implement a permit system requiring the preparation, issuance, use, and cancellation of a confined space entry permit to identify and communicate safety requirements prior to employee entry into permit required confined spaces such as sewer manholes.

29 CFR 1910.146(d)(4): Under the permit space program required by paragraph (c)(4) of this section, the employer shall provide the following equipment (specified in paragraphs (d)(4)(i) through (d)(4)(ix) of this section) at no cost to employees, maintain that equipment properly, and ensure that employees use that equipment properly:    The employer is failing to provide employees entering sewer manholes the equipment necessary to protect them from atmospheric and struck-by hazards.  This condition was most recently observed on or about August 2, 2017, at the intersection of Dorsett and Fee Fee Road, Maryland Heights, Missouri when an employee entered a sanitary sewer manhole to visually inspect the sewer line. The employer failed to provide:        a. Testing and monitoring equipment needed to comply with paragraph (d)(5) of this section;      b. Ventilating equipment needed to obtain acceptable entry conditions;      c. Personal protective equipment insofar as feasible engineering and work practice controls do not adequately protect employees;      d. Barriers and shields as required by paragraph (d)(3)(v) of this section;      e. Rescue and emergency equipment needed to comply with paragraph (d)(9) of this section; and      f. Any other equipment necessary for safe entry into and rescue from permit spaces.

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146:  The employer failed to provide adequate training so that all employees whose work tasks are regulated by 29 CFR 1910.146 permit required confined spaces retained the understanding, knowledge, and skills necessary for the safe performance of duties by the authorized entrant, attendant, and entry supervisor when working to clean and clear obstructions within sewer manholes.
