29 CFR 1926.300(b)(4)(ii): The point of operation of machines whose operation exposes an employee to injury, was not guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. Near Pier Area: An auger rotating in front of an employee was not guarded to prevent the employee access to the pinch point/crushing hazard.

29 CFR 1926.1051(a): A stairway or ladder was not provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided. Near Pier Area: The employer did not provide ladders or steps for employees to access a metal fender located approximately 33 inches above the concrete floor. The employee was possibly exposed to fall hazards.
