29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    At a residential construction site located at 3631 Bell St in Kansas City, MO: Employees were exposed to harmful chemicals that could cause injuries and/or illnesses in that the employer had not developed, or implemented, a written hazard communication program. This was demonstrated at the residential construction site when 4 employees were dispensing gasoline that was used to power the  air compressor for the pneumatic nail guns.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    At a residential construction site located at 3631 Bell Street in Kansas City, MO: Employees were exposed fall hazards. The employer had not developed, or implemented, a safety and health program. The employer failed to train their employees on the recognition of hazards associated with falls. This was demonstrated at the residential construction site when 4 employees were exposed to falls of approximately 20 feet while working from a roof with at pitch of 8/12 and had not been trained to recognize, evaluate, and control exposure to fall hazards.

Employee were using the portable ladder to lift materials and to gain access to a roof. This was demonstrated when a ladder was being used to gain access to the roof did not extend 3 feet above the upper landing.
