OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a tractor equipped with ROPs, overturning or from the operator falling off the tractor due to the tractor not being equipped with seat belts. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to provide and then require the use of the operator restraint system (seat belt)    a) Worksite: Employees operating a John Deere model 5410 tractor, used for odd lifting and towing jobs was not equipped with seat belts.     ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1915.81(a)(3): The employer shall store materials in a manner that does not create a hazard for employees.    a) Center of Back Shop: Employees entering the shop area had to pass directly underneath a wooden shelf which was attached to the ceiling with nails and metal banding. The shelf held eight (8) metal yacht propellers. There was no rail to keep them from slipping off the shelf, and it is unclear if the shelf was constructed in a manner that it could safely hold that much weight.
