29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): 29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. a) On or about August 4, 2017, the employer provided an all-terrain forklift for employee use without ensuring competency to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) On or about August 4, 2017, employees were exposed to the hazard of falling from the edge of the building while performing carpentry work from a second story deck without the use of fall protection. b) On or about August 4, 2017, employees were exposed to the hazard of falling from open sided floors while performing carpentry work from a second story deck without the use of fall protection. Peak Supply, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 1211549, citation 1, item 1, and was affirmed as a final order on May 3, 2017, with respect to a worksite located at lots 13-16 Newberry Lane, Palatine, Illinois. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
