29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Worksite, 3 Dover Ct., Bay Shore, NY: Employees doing renovation work on a residential home were using a ladder to access the 2nd floor (approximately 14 ft.) above ground. The portable ladder used to access the second floor was extended approximately 18 in. above the landing surface; on or about 8/4/17. b) Worksite, 3 Dover Ct., Bay Shore, NY: Employees doing renovation work on a residential home were using a ladder (placed on the 2nd floor) to access the 3nd floor (approximately 10 ft.) above landing below. The portable ladder used to access the third floor was extended approximately 18 in. above the landing surface; on or about 8/4/17. Note: The employer is required to submit abatement certification for this item in accordance to CFR 1903.19.
