29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. On or about August 7, 2017, the employer did not establish an energy control program consisting of energy control procedures, employee training, and periodic inspections. Employees were not protected from the unexpected energization, startup, or release of stored energy while performing servicing and maintenance activities on the metal cutting radial saw #2 and metal cutting radial saw #7. The saws are powered by electrical, pneumatic, and hydraulic power.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. a. On or about July 31, 2017, the employer did not ensure the operator of a metal cutting radial saw, known as saw #2, was protected by an effective guarding device from having any part of their body exposed to the point of operation. b. On or about August 7, 2017, the employer did not ensure the operator of a metal cutting radial saw, known as saw #7, was protected by an effective guarding device from having any part of their body exposed to the point of operation.

On or about August 7, 2017, the employer did not provide employees with training upon their initial assignment on the procedures and use of portable fire extinguishers, or in lieu of the use of portable fire extinguishers developed a written a fire prevention/emergency evacuation program.
