At the establishment, the room housing the emergency eye wash and shower was cluttered with hoses, electrical cords, trash containers, plastic drums and other trash, litter and debris that created slip, trip, and fall hazards.

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  a. At the establishment, employees were given 3M half-face respirators with multi-gas filters to use when processing barrels having contained habanero chiles. A respiratory protection program had not been developed and implemented to include, but not limited to, ensuring employees had passed a medical evaluation to ensure employees could safely wear the respirator while performing work and ensuring employees passed a qualitative or quantitative fit test to ensure employees could maintain a tight respirator fit.

29 CFR 1910.1200(g)(8): The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)  a. At the establishment employees cleaning used containers that had contained products such as, but not limited to, UN 1824 Sodium Hydroxide Solution, Ropinirole Hydrochloride, Furosemide, Plasdone K-90, Mackadet EQ112K, were exposed to contact and inhalation hazards from chemical residue left inside the containers. The company did not maintain copies of the chemical safety data sheets.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  a. At the company employees exposed to chemicals, pharmaceuticals, and food residue present inside containers collected by the company for recycling or disposal had not received information and training to protect them from inhalation and contact hazards. Employees were exposed to chemical, pharmaceutical, and food residue to include, but not limited to, UN 1824 Sodium Hydroxide Solution, Ropinirole Hydrochloride, Furosemide, Plasdone K-90, Mackadet EQ112K, and habanero peppers. The hazards included irritation or damage to the eyes, skin and lungs, health effects due to poison, and the suspected hazards of cancer, genetic mutations, and birth defects.

29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  a. At the workplace, employees operated the company's Kamatsu forklift truck. The employer had not created a written certification of its certified industrial truck operators.
