OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by private own vehicles approaching the temporary traffic control area:   a.  On or about August 8, 2017, at the above addressed work site, the employer did not develop a temporary traffic control  plan when work was being conducted on the roadway.  b.  On or about August 8, 2017, at the above addressed work site, an employee was exposed to the hazard of being struck-by private owned vehicles that traveled on the same road flagman was directing traffic without any flagman paddle.  PLEASE NOTE:  CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.

29 CFR 1926.200(g)(1): Construction areas were not posted with legible traffic signs at points of hazards:  On or about August 8, 2017, at the above addressed work site, an employee was engaged in directing traffic to allow a slow moving work vehicle to leave the road .work zone to an active roadway without having any legible traffic signs indicating "Work Vehicles Entering the Road" or a "Be Prepared to Stop" sign.
