29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes. a) 144 Fulton Street, New York, NY, 3rd floor: On or about 8/8/17, the elevator shaft opening was only partially covered by some materials, exposing employees to a fall hazard of approximately 20 feet. b) 144 Fulton Street, New York, NY, 3rd floor: On or about 8/8/17, the opening containing a ladder to go to the 3rd floor did not have any fall protection system, covers, or guardrails, exposing employees to a fall hazard of approximately 10 feet.

29 CFR 1926.502(b)(3): Guardrail systems shall be capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge. a) 144 Fulton Street, New York, NY, 2nd floor: On or about 8/8/17, the guardrail system consisting of wire ropes for the atrium opening could not withstand a force of 200 pounds. The top wires were drooped significantly, exposing employees to a fall hazard of approximately 10 feet. b) 144 Fulton Street, New York, NY, 3rd floor:On or about 8/8/17, the guardrail system consisting of wire ropes, near the hoisting area, could not withstand a force of 200 pounds. The top wires were drooped significantly, exposing employees to a fall hazard of approximately 10-20 feet.
