29 CFR 1926.451(b)(6): On scaffolds where scaffold planks were abutted to create a long platform, each abutted end did not rest on a separate support surface:      a) On or about July 27, 2017 and at times prior, a foreman of Quest Masonry, Inc. and Funez Stucco LLC were working on each end of the outer planks when one of the workers moved towards the other worker. The planks tilted to one side which caused both workers to fall approximately 40 feet to the ground. Each end of two outer planks was not rested on a supported surface. Each abutted end of the outer planks was rested on the extended side of the outrigger planks.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration; Such activities were not performed only by experienced and trained employees selected for such work by the competent person:   a) On or about July 27, 2017 and at times prior, a foreman of Quest Masonry, Inc. and Funez Stucco LLC were not trained or experienced on erecting and altering a scaffold. The two workers erected and altered the fifth level of the scaffold. Outrigger planks were not nailed, bolted, or secured to the outriggers; each abutted end of the outer planks was not rested on a supported surface; and guardrail systems were not installed along all open sides of the platform. The workers were working on each end of the outer planks when one of the workers moved towards the other worker. The planks tilted to one side which caused both workers to fall approximately 40 feet to the ground.

A foreman of Quest Masonry, Inc. and Funez Stucco LLC were working on each end of the outer planks when one of the workers moved towards the other worker. The planks tilted to one side which caused both workers to fall approximately 40 feet to the ground.

29 CFR 1926.451(g)(2): The employer did not provide fall protection for employees erecting or dismantling supported scaffolds:      a) On or about July 27, 2017 and at times prior, a foreman and his workers were exposed to approximately 40 feet while adding outer planks at the fifth level of the scaffold. The employer did not provide fall protection system to the workers while adding two outer planks of the scaffold.
