29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:    The Andersons, Inc. - Maumee, Ohio:  On or about August 9, 2017 the employer did not make a reasonable estimate of respiratory hazards for employees performing clean-out operations of a pressure differential hopper bottom railcar (TGMX 440181) at the company's railcar repair yard.  Employees were exposed to respiratory hazards associated with cement powder during the cleaning operations.

29 CFR 1910.1200(e)(1): Employer did not develop or implement a written hazard communication program which at least included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):     The Andersons, Inc. - Maumee, Ohio:  On or about August 9, 2017 employees were exposed to engulfment hazards from flowing cement powder while cleaning a pressure differential hopper bottom railcar (TGMX 440181) at the company's railcar repair yard.  The employer did not implement methods to inform employees of the hazards associated with non-routine tasks, such as cleaning out cement powder in railcars.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    The Andersons, Inc. - Maumee, Ohio:  On or about August 9, 2017 employees were exposed to engulfment hazards from flowing cement powder while cleaning a pressure differential hopper bottom railcar (TGMX 440181) at the company's railcar repair yard.  The employer did not provide effective information and training to employees of the hazards associated with cement powder which was being cleaned from the railcars.
