29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan: On or about 8/14/2017 at Debra Wattenberg M.D. PC located at 875 5th Avenue New York, NY 10065, medical assistants who use BD vacutainer safety-Lok needle to draw blood from patients were exposed to bloodborne pathogens. (a) The employer failed to solicit input from employees about engineering controls for sharps such as but not limited to BD vacutainer safety-Lok needles. (b) The employer failed to solicit input from employees on work practice controls regarding the disposal of BD vacutainer safety-Lok needles. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY.
